ingo, its precisely because we understand that sshd is so important that we've moved it to upstart, which should give it the ability to respawn automatically and be started earlier in the boot.

That much has been tested and it works. This bug is only concerning an oversight in understanding of how people used /etc/init.d/ssh ... the fix is minimal and should easily be backportable to prior versions.
